Court: Records of the ownership of property around The Pool 1750-1819, 1776, Ferryland, Newfoundland and Labrador, Canada. ¹⁴⁸¹ This information forms part of the massive Carter-Nason court case file at The Rooms. Specifically a summary of land tenure assembled by John Noonan's lawyer to support his claim of ownership by inheritance of most of those lands. Vol. 6, Page 149 Mrs. Catherine Weston's daughter, namely Catherine Weston the younger was married to late William Carter. This recorded property of Mrs. Weston's came to his possession by her marriage. Shea( Mary) tenant to Richard Nason by the Decrees 1763 appears in Number 2------ admitted in this record of Catherine Weston , Mother-in law of late William Carter, father of Peter, Robert and Arthur Carter of Saint John's and Ferryland Nason, Benger and Double were one family by marriage and who lived together. Nason survived after Benger'' death and Double leaving the country 1776 in holding agents over said property to Nason's death 1825 Remark said Robert Carter was tenant to Richard Nason 1763 three years before this record was executed his sons William Carter was married to one of Mrs. Weston's daughters. This record shows no more than the premises on the beech with Carneys meadows there recorded in their possession with provisoes and holdings ??? be held only during his Majesty's pleasure and further not to prevent the fishery in its prosecution by the holding of said premises now in possession of late William Carter's family By Command of His Excellency Governor and Commander in Chief over the Island of Newfoundland. Whereas Mrs. Catherine Weston widow of late Peter Weston, Esq. of Ferryland deceased presented me a petition setting forth that her late husband was at the time of his death seized of several houses, stores, wharfs, fishing rooms, stages , flakes, fields and gardens in the Harbour of Ferryland aforesaid by the last will and testament of Peter Weston deceased that she and her two daughters,Catherine and Sarah Weston, were made co-heirs and joint executors by the last will and testament stating that the Records of Ferryland wherein the grants , boundaries and descriptions of said property were inserted been destroyed by fire in 1740, that said Catherine Weston do now cause a survey to be taken by five of the inhabitants of this Harbour showing the situations limits of boundaries of her late husband's property, That from the Northeast corner of the garden fence to Weston's dwelling house high water mark 1673 feet, E and S to W by N from NE corner of the garden bounded by foot path to Weston's house where he now live to high water mark 102 feet S by W, E by N from end of new house towards Mary Shea's dwelling house and high water mark 102 feet S by W and E by N of new house and Mary Shea's dwelling house by footpath 39 feet E and W from the corner of said dwelling house to the Coopers Shop formerly belonging to one Giles now rented by Mr. Sweetland 19 feet N and S bounded by the path to the Coopers Shop high water mark 22 feet North of Mary Shea's stage and Sweetland's wharf South corner of Sweetland's store bounded by the corner of Weston's store S W side of path passing between said store and Mr. Double's store 136 ½ feet N and S bounded by footpath East of red store to high water mark 88 feet including the footpath of 6 feet N. E and SW bounded by the side of William Double's store breadth of Sweetland's stage from corner to corner 35 feet long by 124 the vacant spot 37 feet ,3 inches breadth. NB. The ground bounded between Mr. Sweetland's store to path by Mr. Double's store is the property of Catherine Weston and two daughters with the exception of those parts mentioned carries its front to water by same breadth and measurement back to beech in length from side path opposite Mary Shea's dwelling house to corner of flake opposite Weston's Cook Room next Nicholas Audley's dwellings to corner of meadow next Allen the Smith's bounded by the path 216 feet WSW and ENE next meadow 75 feet S by E and N by W corner of Mary Shea's flake formerly Tucker's now in possession of Mrs. Weston 114 feet corner of Mary Shea's flake the beech to Mrs. Westons 150 feet NE and SW next end of beech 96 feet known by Tucker's next the meadows by E by W with small corner next to Sweetland's flake to the end of Double's flake 36 feet from the last measured place to the end of Sweetland and Tucker's flakes 228 feet SW by SE next Shea's flake 150 feet SW and NE the small flake joining the Flag Staff Room to corner of red store 150 feet opposite Double's store 30 feet NE and SW breadth 18 feet NE next Double's store the meadow length from corner of flake to Allen the Smiths and John Carney's dwelling 94 feet bearing as follows 67 feet WSW and ENE 139 feet WNW and ENE 96 feet W 254 feet WSW to ENE 96 feet W and E 254 feet ENE 90 feet SSW to NNE 294 feet to the side fence bounded by Admiral's Beech length 296 feet bearing E by S and W by N the end fence 24 feet NW by SE. Mrs. Catherine Weston prays she and two daughters that I may grant them the quiet and peaceable enjoyment of the aforesaid premises as I have caused an enquiry to be made by John Burndell, Esq my Surrogate and Robert Carter, Esq, his Majesty's justice of the peace for the district of Ferryland respecting the truth of Mrs. Catherine Weston's memorial as regards the last will and testament of Peter Weston deceased with the situation of boundaries of the several houses, stores, gardens, fields, wharfs, fishing rooms, stages and flakes above mentioned to be true I give and grant to Catherine Weston and two daughters the elder Catherine, the younger Sarah the quiet and peaceable possession of all the above mentioned premises agreeable to the last will of Peter Weston during his Majesty's Royal Will and pleasure and strictly forbids any persons, their heirs, and leans, Administrators or assignees provided it must be decreed and understood as relates the fishery it cannot be held longer than a particular time by act of Parliament made 10 th and 11 th year of King William the Third entitled an Act to encourage the Trade of Newfoundland. That the fishing works be kept in good proper condition at all times in the persecution of the fishery.
