That your petitioner's late brother John Squarey Clapp late of Teignmouth County Devon England gentleman discarded this life on or abour the thirteenth day of November AD Eighteen hundred and eighty having Greviously made and Published his last will and testament exemplification of probate whereof is hereto annexed
That by his said will the said late John Squarey Clapp appointed his niece Mary Bulley Clapp sole Executrix thereof.
That by power of attorney hereto annexed the said Executrix nominated and appointed your petitioner to apply for and take out in Newfoundland letters of administration.



Administration cum testamento annexo of the Estate in Newfoundland of the said late John Squarey Clapp. That the said John Squarey Clapp left him surviving.
That at the time of his decease the Estate of the said late John Squarey Clapp in this Colony did not exceed the sum of Seventy five thousand five hundred dollars in value.
That no administration of said Estate in Newfoundland hath been granted by your Honourable Court.

This is the last will and Testament of Mr. John Squarey Clapp of Teignmouth in the County of Devon Gentleman I appoint my niece Mary Bulley Clapp to be sole Executrix of my will. I give devise and bequeath unto my said Niece Mary Bulley Clapp absolutely her heirs executors administration and assigns all my share and shares estate and interest whatsoever in the pieces plots and parcels of land with the several dwelling houses shops stores warehouses wharves cellars platforms and buildings thereon situate in Water Street and Duckworth Street in St. Johns in the Island of Newfoundland to which I am Entitled under and by virtue of the will of my late Father bearing date on or about the thirteenth day of May One thousand Eight hundred and forty seven and a Conveyance from my brother Robert Clapp bearing date on or about the thirty first day of July one thousand Eight hundred and forty two I give and ??? that ??? Dwelling house far??? hereditaments and premises situate in Ieip? Street in the parish? Weal? Teignmouth in the County of Devon now in my own occupation with the appurtenances unto my said Niece Mary Bulley Clapp her heirs and assayers for ever. I give and bequeath all my household furniture plate linen china glass books, presents pictures and all other household effects of which I shall die possessed unto my said niece Mary Bulley Clapp absolutely. I give and bequeath to my said Niece Margaret Clapp all and singular the monies in the public stocks funds or government securities of Great Britain to which I am entitled under or by virtue of the will of my deceased sister Mary Frances Bulley Clapp. I bequeath the pecuniary legacies following namely to each of the sons of my Brother William Clapp who shall be living at the time of my decease a legacy of one hundred pounds sterling and to my servant Resia? This is the last will and Testament of me John Squarey Clapp of Teignmouth in the County of Devon England Gentleman. I appoint my niece Mary Bulley Clapp to be sole executrix of my will I give devise and bequeath unto my said niece Mary Bulley Clapp absolutely her heirs executors administrators and assigns all my share and shares estate and interest whatsoever in the pieces plots and parcels of land with the several dwelling houses shops stores warehouses wharves cellars platforms and buildings thereon situate in Water Street and Duckworth Street in St. John's in the Island of Newfoundland to which I am entitled under and by virtue of the will of my late father bearing date on or about the thirteenth day of May one thousand eight hundred and forty seven and a conveyance from my brother Robert Clapp bearing date on or about the 31st day of July one thousand eight hundred and forty two. I give and devise all that messuage or dwelling house garden hereditaments and premises situate in Teign Street in the Parish of West Teignmouth in the County of Devon now in my own occupation with the appurtenances unto my said niece Mary Bulley Clapp her heirs and assigns for ever. I give and bequeath all my household furniture plate linen china glass books prints pictures and all other household effects of which I shall die possessed unto my said niece Mary Bulley Clapp absolutely. I give devise and bequeath all the share and interest whatsoever of and in the dwelling houses shops warehouses wharves cellars platforms buildings hereditaments and premises situate in St. John's in the Island of Newfoundland aforesaid to which I am entitled under and by virtue of the will of my late sister Mary Frances Bulley Clapp unto my brother Gilbert Clapp his heirs executors administrators and assigns and if my said brother Gilbert Clapp shall die in my life time then I give devise and bequeath the same hereditaments and premises unto such of the children of my said brother Gilbert Clapp as shall be living at the time of my decease in equal shares as tenants in common their respective heirs executors administrators and assigns. I give and devise to my said niece Mary Bulley Clapp a yearly rent charge of one hundred and forty pounds sterling for her life to be charged upon and issuing out of my dwelling houses shops warehouses wharves cellars platforms buildings hereditaments and premises situate at St. John's in the Island of Newfoundland not hereinbefore devised and hereinafter more particularly described and to be payable half yearly without deduction and the first payment of the said yearly rent charge of one hundred and forty pounds sterling to be made at the end of six calendar months computed from my decease and a proportionate part of said yearly rent charge is to be paid up to the determination thereof. John's occupation is Ship Owner, Mary Frances Bulley Clapp, Maria Cecilla Clapp and Caroline Clapp's occupation is Fund Holder.

In 1871 census John Squarey Clapp b:1805 was living at Teign Street, West Teignmouth, with his Niece Mary Bulley Clapp.

The Will of John Squary Clapp late of Teignmouth in the County of Devon Gentleman who died 13th November 1880 at Teignmouth was proved at Exeter by Mary Bulley Clapp of Teignmouth Spinster the Niece the sole Executive. Probate date 3rd December 1880 Estate at death under Ł3,000.

John Squary Clapp is listed in Canada Seafarers of the Atlantic Provinces 1789-1935 on Brig Hope, occupation Merchant year 1825. Again on Brigatine 1841 he is now the owner. 2638

MARY BULLEY CLAPP

THIS IS THE LAST WILL AND TESTAMENT of me MARY BULLEY CLAPP of Burnside Whitchurch in the County of Devon Spinster.

I appoint my Brother Robert Clapp and my Brother William Mainwaring Clapp to be the EXECUTORS and TRUSTEES of this my will
I declare that in the interpretation of this my will the expression "my trustees" shall (where the context permits) mean and include the trustees for the time being hereof whether original or substituted and I appoint my trustees to be trustees hereof for all purposes of the Settled Land Acts 1882-1890 and section 42 of the Conveyancing and Law of Property Act 1881.
I bequeath the following pecuniary legacies
(a) To my brother Robert Clapp the sum of six hundred pounds
(b) To my niece Georgiana Mary Hocken daughter of my late sister Jessie Hocken the sum of Four hundred pounds.
(c) To my niece Jessie Mabel Class daughter of my said late sister Jessie Hocken the sum of One hundred and fifty pounds.
I give devise and bequeath to my said brother William Mainwaring Clapp his heirs Executors administrators and assigns absolutely all my share or shares estate and interest bequeathed to me by my late Uncle John Squarey Clapp of and in the land shops and premises situate in Water Street and Duckworth Street Saint John's in the Island of Newfoundland and in the event of my said brother predeceasing me then I give devise and bequeath the same unto such of the children of my said brother as shall be living at my decease in equal shares as tenants in common.
I give devise and bequeath unto my said trustees their heirs Executors administrators and assigns all my monies and investments of whatsoever description and wheresoever invested after paying thereout the aforesaid legacies my just debts funeral and testamentary expenses Upon Trust to apply the income arising there from for the use and benefit of my sister Margaret Clapp during her lifetime and on her decease I give and devise the same (capital as well as income) to my said Brother William Mainwaring Clapp his heirs Executors administrators and assigns absolutely but in case the said William Mainwaring Clapp shall predecease me or my said sister then I give and devise the same (capital as well as income) on my sisters decease unto such of the children of my said Brother William Mainwaring Clapp as shall be living at my decease in equal shares as tenants in common.
All the rest residue and remainder of my real and personal estate whatsoever and wheresoever situate including any furniture pictures prints plate linen silver books and other household and personal effects belonging to me at my decease together with any property of any description which may come to me at any future period under the will of any member of my family I give and bequeath to my said Brother William Mainwaring Clapp absolutely and in the event of my said Brother predeceasing me then I give and bequeath the same unto such of the children of my said brother as shall be living at my decease in equal shares as tenants in common.

MARY BULLEY CLAPP

THIS IS THE LAST WILL AND TESTAMENT of me MARY BULLEY CLAPP of Burnside Whitchurch in the County of Devon Spinster.

I appoint my Brother Robert Clapp and my Brother William Mainwaring Clapp to be the EXECUTORS and TRUSTEES of this my will
I declare that in the interpretation of this my will the expression "my trustees" shall (where the context permits) mean and include the trustees for the time being hereof whether original or substituted and I appoint my trustees to be trustees hereof for all purposes of the Settled Land Acts 1882-1890 and section 42 of the Conveyancing and Law of Property Act 1881.
I bequeath the following pecuniary legacies
(a) To my brother Robert Clapp the sum of six hundred pounds
(b) To my niece Georgiana Mary Hocken daughter of my late sister Jessie Hocken the sum of Four hundred pounds.
(c) To my niece Jessie Mabel Class daughter of my said late sister Jessie Hocken the sum of One hundred and fifty pounds.
I give devise and bequeath to my said brother William Mainwaring Clapp his heirs Executors administrators and assigns absolutely all my share or shares estate and interest bequeathed to me by my late Uncle John Squarey Clapp of and in the land shops and premises situate in Water Street and Duckworth Street Saint John's in the Island of Newfoundland and in the event of my said brother predeceasing me then I give devise and bequeath the same unto such of the children of my said brother as shall be living at my decease in equal shares as tenants in common.
I give devise and bequeath unto my said trustees their heirs Executors administrators and assigns all my monies and investments of whatsoever description and wheresoever invested after paying thereout the aforesaid legacies my just debts funeral and testamentary expenses Upon Trust to apply the income arising there from for the use and benefit of my sister Margaret Clapp during her lifetime and on her decease I give and devise the same (capital as well as income) to my said Brother William Mainwaring Clapp his heirs Executors administrators and assigns absolutely but in case the said William Mainwaring Clapp shall predecease me or my said sister then I give and devise the same (capital as well as income) on my sisters decease unto such of the children of my said Brother William Mainwaring Clapp as shall be living at my decease in equal shares as tenants in common.
All the rest residue and remainder of my real and personal estate whatsoever and wheresoever situate including any furniture pictures prints plate linen silver books and other household and personal effects belonging to me at my decease together with any property of any description which may come to me at any future period under the will of any member of my family I give and bequeath to my said Brother William Mainwaring Clapp absolutely and in the event of my said Brother predeceasing me then I give and bequeath the same unto such of the children of my said brother as shall be living at my decease in equal shares as tenants in common.
IN WITNESS whereof I have hereunto set my hand this 24th day of July one thousand nine hundred and twenty five.

I MARY BULLEY CLAPP of Downside Whitchurch in the County of Devon Spinster declare this to be a FIRST CODICIL to my will which bears date the twenty fourth day of July One thousand nine hundred and twenty five Whereas by my said will I have appointed my Brother Robert Clapp to be an Executor and Trustee thereof together with my brother William Mainwaring Mainwaring referred to in the said will as William Mainwaring Clapp and whereas by my said will I have bequeath a legacy of four hundred pounds to Georgiana Mary Hockan and also a legacy of One hundred and fifty pounds to Jessie Mabla Class and whereas my said brother Robert Clapp died on the twenty seven day of January One thousand nine hundred and thirty.
(1) Now I hereby revoke the appointment of my said brother Robert Clapp as Executor and Trustee of my said will and appoint my nephew Ray Mainwaring Mainwaring formerly called Ray Mainwaring Clapp to be EXECUTORÂ and TRUSTEE thereof in place of my said Brother Robert Clapp and I declare that my said will shall be construed as if the name of the said Ray Mainwaring Mainwaring were substituted therein for the name of my said brother Robert Clapp and I further appoint my said Brother William Mainwaring Mainwaring and my said nephew Ray Mainwaring Mainwaring to be trustees of my said will for all the purposes of the settled Land Act 1925
(2) I hereby revoke the bequest of the legacy of Four Hundred Pounds to Georgiana May Hocken and in lieu thereof and in substitution therefore bequeath to her a legacy of One hundred pounds
(3) I hereby revoke the bequest of the legacy of One hundred and fifty pounds to Jessie Mabla Class and in lieu thereof and in substitution therefor bequeath to her a legacy of One hundred pounds
(4) In all other respects I confirm my said will
IN WITNESS whereof I have hereunto set my hand this twenty sixth day of April one thousand nine hundred and thirty.
