It is with deepest sorrow that we announce that Susan Page Livingston has departed this life. Susan died suddenly on July 13, 2016 after celebrating her mother's 90th birthday among friends and family in Kelowna, B.C. Susan is survived by her heart-broken husband, Bill Turecki; mother, Gwenda; daughter, Mackenzie; son, Aaron; brother, Andrew; and sister, Mary Lou. She was predeceased by her father, Robert "Bob" Livingston. Susan spent her happiest years growing up in Vancouver and later in life living in the beach side community of Boundary Bay. Family and friends were at the centre of her life. She left an indelible footprint in all of their hearts and they in hers. She will be sorely missed by all who knew her. In lieu of flowers, the family asks that you please consider making a donation to the Fraser Valley Library Association (1-888-668-4141). A Celebration of Life for Susan will be announced at a later date.

In the name of God Amen I Sidney Spear Carter of Saint John's in the Island of Newfoundland wife of Peter Weston Carter of the same place Esquire being of sound and disposing mind and memory do by virtue of a power to me in that behalf before my intermarriage with my said husband make and publish my last will and testament in manner following that is to say I hereby give and devise to my sons Peter Hart Carter and Frederic B. T. Carter and their heirs whom I also appoint executors hereof all my lands tenements and hereditaments to which I am in anywise entitled wheresoever situate upon the several trusts hereinafter expressed that is to say in trust to pay unto or empower and permit my said husband to receive the rents issues and profits thereof during his natural life and from and immediately after his decease upon further trust that they the said trustees or the survivors of them and his heirs shall and do thenceforth pay and apply the rents issues and profits thereof towards the support and maintenance of such of my daughters as may remain unmarried during the terms of their respective natural lives the share of either contracting marriage or dying to be divided amongst the survivor or survivors of them in equal proportions and upon the marriage of all my said daughters or their deaths whichever may first happen then upon this further trust to convey release and assure the said lands messuages and hereditaments to all my children then surviving (or their representatives taking per stirpe and not per capita) save as hereafter excepted) as tenants in common, my said trustees retaining their shares, the shares of my daughters not to be subject to the debts control or engagements of their respective husbands but should either of my said children die leaving no child or children him or her surviving the share of him or her so dying shall be divided amongst the survivors or their representatives in equal proportions, it is also my especial will and desire that the share to my son William is upon this express condition that if he marry during the lifetime of the said Peter Weston Carter without his consent in writing first had and obtained or if after the decease of my said husband without the consent of my trustees or the survivor of them or his heirs aware as they are of my reasons for imposing this restraint and feeling convinced he or they will not capriciously refuse their consent, then the share intended for my said son shall be divided equally amongst my other children and their respective representatives upon the conditions aforesaid after the decease of my said son who shall have a life interest thereon only.
And I further empower my said trustees or the survivor of them during the intervening trusts and before the final release aforesaid to demise lease or grant any part of the premises aforesaid upon such terms as they or the survivor of them aforesaid may think most conducive to the interests of all (during the lifetime of the said Peter Weston Carter first having his approbation) and I hereby authorize my said Trustees to reimburse themselves for all advances made and all expenses incurred incidental to the execution of the said trusts and they or their either of them shall not be restricted in any manner different from my other children in purchasing or taking the share of the other or others of them or otherwise howsoever. See the notes from the diary of Magistrate William Sweetland in the Medical notes. Apparently both the father, Peter, and his eldest son, William, were reprobates in the eyes of Sweetland.

From the Miscellaneous Deeds and Wills collection (GN169) at The Rooms:

Peter Weston Carter was the son of Judge William Carter and, as such, was by no means a poor man. He held positions of responsibility, including as the Registrar of the Vice-Admiralty Court and as a Commissioner of the Court of Oyer and Terminer. So this document suggests that his spouse to be, Sydney Spear Livingstone, must have been wealthy indeed for there to have been a perceived need for what was essentially a prenuptial agreement, although it was phrased as just another Indenture. I know nothing concerning her father John Livingstone, except that he was deceased at this time and she was co-heiress of his estate along with her brother, Charles, and this may have been the reason for this precaution being taken. The manner in which her fortune is secured is via her turning it all over to a trustee in the person of John Williams. It was the trustee's responsibility to mange the rental of all properties left to Sidney in her father's estate, to maximize the rents obtained and invest the proceeds and, at his discretion, to sell any of the assets if that seemed more propitious at the time. But unlike prenuptial agreements today, the husband was to be entitled to lay claim to the interest accrued on the trust, presumably for the benefit and upkeep of his wife. But if Peter should predecease her, the entire fortune was to revert to her at that time. The reason this indenture was necessary at this time was that only a man could make substantial decisions on the acquisition or sale of property and hence John Williams had to have this indenture in hand to allow him to accept direction on the management of the fortune from Peter Weston Carter.

On Dec. 24, 1849 an indenture was registered at the Central District Court (now retained at the Registry of Deeds) which involved three sisters (or their heirs) to the estate of John Livingstone. By this indenture the property which was held in common by them was divided into three equal parts with part B going to the son of one of them, John W. McCurdy (son of the deceased sister, Elizabeth, and her late husband, Lieut. John McCurdy): CDC Vol 12 Fol 33-35 Peter W & Sydney S Carter et al to john W McCurdy 24-12-1849
I discovered this indenture during a systematic exploration of the CDC records made possible by Steve Barnable having given me a complete copy of digital images of all the documents in the registers of the three District Courts, Southern, Central and Northern. But I had previously come across a document on the same matter dated much later: CDC Vol 22 Fol 535-538 Frederick B T Carter Ex Sydney S to Rev Thomas J Power 01-11-1872
In this later document, it would appear that all of the principals in the original indenture are now dead and gone and Frederick B. T. Carter, the son and executor of Sydney Spear [Livingstone] Carter, is selling her 1/3 share of the Livingstone estate to the RC Church. 6259
In his diaries (MUN Digital Archive Initiative), Magistrate William Sweetland has this to say about her passing:
"On Saturday the 2nd Novr [1850] I attended the Remains of Mrs Peter Carter to her last resting Place in the Cemetery near quidi vidi Pond in the South East thereof. She had numbered 60 years. for a considerable time before her decease she had been confined to her Bed Room and the last three or four Months deprived of Reason with now and then short Intervals of Recollection in which she would recognize those around her. She has left a large family of unmarried females and two Sons unsettled in Life one I fear a cast away and that her eldest born. Well Intemperance must have its Voltaries as well as its Victims but what shall we say or can be said where the head of the family forgets the dignity which attaches to his Station as a Man & a father and sets the example to his children & his Juniors !!! It is a pity & a pity, tis, tis true. I regret it extremely that such should be the case."
It seems that Sweetland blames the father for the dissipation of the son. This was clearly a case of Dementia or Alzheimers, though they had no name for it in those days.
